Terms of Service

Please read these Terms of Service ("Terms") for the PackageIQ website, platform and other services (defined below) that we provide to you, the client ("Client", "you" or "your"). Each separate set of Terms below applies to you in full and is identified by its own heading. In reviewing these Terms and accessing the Site or the Platform, or availing yourself of our services, you agree to and accept each of them as an agreement between you and OD Fextor, trading as PackageIQ ("PackageIQ", "us", "we" or "our"). Where needed, Client and PackageIQ are referred to together as the "Parties" and each individually as a "Party".
PackageIQ may revise, amend, modify or delete portions of these Terms at any time. Updated versions are published on this page and the date above is changed accordingly. It is at all times your responsibility to read the most current version. Your continued use of the Site or of our services constitutes your acceptance of any revision. Where a revision is material, we will additionally notify registered users by email at least 14 days before it takes effect.
PackageIQ Website Terms of Service
PackageIQ operates package-iq.com together with its affiliated websites, subdomains and webpages (collectively, the "Site").
By accessing or using the Site in any way, you unconditionally accept the following Website Terms, on your own behalf or on behalf of the entity that you represent, as the legally binding terms for any type of access to and use of the Site in any form. You agree that you will comply with all applicable laws, rules and regulations when accessing, browsing, reviewing or in any other way using the Site. The Site may contain additional notices, the terms of which must also be observed.
1) Licence and restrictions on use
Subject to your ongoing compliance with these Website Terms, PackageIQ grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and freely revocable licence to access and use the Site solely for your lawful purposes, provided that we retain all copyright, trademark and other intellectual property in it. All other rights are expressly reserved.
You shall comply with these Website Terms and shall not:
- archive, download, reproduce, distribute, modify, display, publish, license, create derivative works of, offer for sale or otherwise exploit any content or information contained in or obtained from the Site, beyond ordinary use of the Site as intended;
- delete or obscure any copyright or other proprietary rights notices on the Site;
- circumvent, remove, alter, deactivate, degrade or thwart any of the protections enabled on the Site;
- use any robot, spider, scraper or other automated means to access the Site;
- decompile, reverse engineer or disassemble any software, product or process accessible through the Site;
- insert any code, or otherwise manipulate the Site in any way;
- use any data mining, data gathering or extraction method against the Site;
- upload, post, email or otherwise transmit any material designed to interrupt, destroy or limit the functionality of any software, hardware or telecommunications equipment associated with the Site, including viruses or other harmful code; or
- use, or encourage the use of, the Site for any illegal purpose or in violation of any local, national or international law, including laws governing intellectual property, data protection and privacy.
PackageIQ has the right to alter, suspend or discontinue the Site, or your access to and use of the Site, at any time and for any reason, without notice or liability to you or any third party.
2) Third-party sites
PackageIQ makes no representations whatsoever about any third-party content accessible through the Site. When you access non-PackageIQ content, note that it is independent of PackageIQ and that we have no control over that website, even where we provide information or services to its owner. A link to a non-PackageIQ website does not mean that PackageIQ endorses or accepts any responsibility for the content or the use of that website, and we disclaim all liability for it. It is up to you to take precautions to ensure that whatever you select for your use is free of viruses, worms, trojan horses and other destructive items.
3) Copyright and use of Site content
The copyright in all materials, features and functionality on the Site, including text, graphics, video, audio, software, algorithms, artwork, interfaces, photographs, logos, icons and images, and the selection and arrangement of them together with any enhancements or derivative works ("Content"), is the exclusive property of PackageIQ or its licensors and is protected by applicable national and international law. No Content may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means without the prior written permission of PackageIQ or the relevant copyright owner in each instance. You shall not "mirror" or "frame" any Content or the Site itself, in whole or in part, without our express written permission.
Any unauthorised use of the Content may breach copyright law, trademark law, the laws of privacy and publicity, or communications regulations. All rights not expressly granted are reserved. You are solely responsible for ensuring that any information or Content obtained from the Site does not contain any code or subroutine designed to disable, erase, impair or otherwise damage your systems, software, data or operations.
4) Trademarks
The trademarks, service marks, logos and trade names used and displayed on the Site, including PackageIQ, are the registered and unregistered trademarks of PackageIQ (the "Trademarks"). Other trademarks, service marks, logos and trade names may be owned by others. Nothing on the Site should be construed as granting any licence or right to use any Trademark or any other PackageIQ intellectual property displayed on the Site.
The Trademarks shall not be used in any way, including in advertising or publicity relating to distribution of Content on the Site, without our prior written permission, and you shall not refer to or attribute any information to PackageIQ or its licensors in any public medium for promotional or advertising purposes, or for the purpose of influencing a third party. PackageIQ also prohibits use of the Trademarks as part of a link to or from any site unless the link has been approved in advance by us in writing.
5) No professional services
The information on the Site and its Content does not under any circumstances constitute the rendering of legal, regulatory, engineering, accounting, tax or any other professional advice or services, and no advisory relationship is formed by your use of the Site.
6) Disclaimer of warranties
THE SITE, INCLUDING ALL CONTENT ON IT, IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PACKAGEIQ DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WITHOUT LIMITATION, PACKAGEIQ DOES NOT REPRESENT OR WARRANT THAT: (1) THE INFORMATION ON THE SITE IS CORRECT, ACCURATE OR RELIABLE; (2) THE FUNCTIONS CONTAINED ON THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE; OR (3) DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVER THAT MAKES IT AVAILABLE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ACKNOWLEDGE THAT USE OF THE SITE IS AT YOUR SOLE RISK.
Nothing in this clause excludes or limits any warranty or right that cannot be excluded or limited under the law applicable to you, including mandatory consumer protection law.
7) Exclusion of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER PACKAGEIQ NOR ITS OWNERS, SUCCESSORS, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, REPRESENTATIVES OR ADVISERS SHALL BE LIABLE FOR ANY DAMAGES, INCLUDING DIRECT, INCIDENTAL, PUNITIVE, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, THAT DIRECTLY OR INDIRECTLY RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE SITE OR THE INFORMATION, CONTENT, SOFTWARE, PRODUCTS AND SERVICES ADVERTISED OR CONTAINED ON IT, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EVEN IF PACKAGEIQ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS APPLIES WITHOUT LIMITATION TO DAMAGE ARISING FROM ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, FILE CORRUPTION, COMMUNICATION-LINE FAILURE, NETWORK OR SYSTEM OUTAGE, OR THEFT, DESTRUCTION, UNAUTHORISED ACCESS TO, ALTERATION OF, OR USE OF ANY RECORD.
Nothing in these Website Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.
8) Indemnification
You shall indemnify, defend and hold harmless PackageIQ and its owners, successors, affiliates, officers, employees, agents, representatives and advisers (together, the "PackageIQ Indemnified Parties") from and against any and all liability and costs, including reasonable legal fees, incurred by any of them in connection with any claim arising out of or relating to: (i) your access to or use of the Site; or (ii) any breach by you of these Website Terms or of the representations, warranties and covenants you have made by agreeing to them. You shall cooperate fully in the defence of any such claim.
9) Enforcement of these terms
These Website Terms are governed by and interpreted under the laws of Bosnia and Herzegovina, without regard to conflict of law principles. You agree to the exclusive jurisdiction of the courts of Sarajevo, Bosnia and Herzegovina in connection with any dispute or claim involving PackageIQ in relation to the Site, unless mandatory consumer protection law in your country of residence gives you the right to bring proceedings elsewhere. If any part of these Website Terms is unlawful, void or unenforceable, that part is severable and does not affect the validity and enforceability of the remaining provisions.
10) Entire agreement
These Website Terms constitute the entire agreement between you and PackageIQ with respect to the Site, and supersede all prior or contemporaneous understandings or agreements, written or oral, regarding that subject matter. Any waiver of any provision is effective only if made in writing by PackageIQ. Any failure to enforce a provision is not a waiver of a future breach of that or any other provision.
PackageIQ Platform Terms of Service
These Platform Terms of Service ("Platform Terms") set out the terms on which PackageIQ grants the Client access to, and the Client acquires the right to use, the PackageIQ application, its AI-assisted packaging analysis, the reports, design proposals, research library, and the other material, information, content, documents, functionality and works of authorship offered through it (collectively, the "Material" and the "Platform").
PackageIQ will only provide access to the Material described in these Platform Terms and on the Platform itself. We do not, and are not deemed to, provide any other service. The Client acknowledges that PackageIQ does not and cannot make any strategic, operational, regulatory or other business decision on the Client's behalf. Those decisions, and their implementation, are the exclusive responsibility of the Client.
1) The Platform
PackageIQ provides AI-assisted packaging analysis and strategic recommendations for manufacturers, brand owners and distributors. Reports are generated by combining the product context you submit with large language models and a curated research library, and are delivered in the application, by email and as a PDF stored in your account.
Reports are advisory in nature. They do not constitute legal, regulatory or engineering advice. You are responsible for validating recommendations with qualified professionals before making packaging, marketing or compliance decisions.
2) Client obligations and rights
Account eligibility
To hold a PackageIQ account:
- you must be capable of entering into a binding contract under the law of your country of residence;
- you must provide accurate registration information and keep it up to date;
- one person or legal entity may not maintain more than one free account; and
- accounts may not be shared or transferred without our written consent.
Business operations
You oversee all aspects of the operation of your own business, including the design, production and delivery of your own products and packaging, your accounting, and your regulatory filings. You bear sole responsibility for all aspects of your use of the Material, including its use in any agreement with a third party. Except as expressly set out in these Platform Terms, all responsibility and liability regarding any use of the Material is yours alone.
Technical requirements and credentials
You are solely responsible for meeting the technical requirements necessary to use the Platform, including a secure internet connection and suitable equipment and software. You are responsible for the confidentiality of your account credentials, which you may not share with any third party, and for all activity carried out under your account. You must notify us immediately of any suspected or actual unauthorised use of your credentials or any other known or suspected breach of security, and must use your best efforts to prevent one.
Acceptable use
You agree not to:
- submit false or misleading product data, or third-party product data you are not authorised to submit;
- attempt to reverse engineer, scrape or extract the underlying AI models, prompts or research library;
- use the Platform to generate reports for resale without a written commercial licence from us;
- circumvent rate limits, access controls or billing mechanisms; or
- use the Platform in any way that breaches applicable law or infringes third-party rights.
We may suspend or terminate an account that breaches these restrictions, with or without notice.
Licences and authorisations
If you are required to be licensed, registered or certified under any applicable law, or to act under the supervision of a licensed person or entity, in order to perform your duties or place your product on a market, you are solely responsible for verifying and maintaining that licensure, registration, certification or supervision.
3) Proprietary rights
Ownership
PackageIQ, or its third-party vendors where applicable, own all right, title and interest, including copyright, trademarks, trade names, know-how, design rights, trade secrets and other intellectual property rights, whether registered or unregistered, in the Platform and the Material, including any derivative works or improvements of them. The Material does not include third-party programs, materials or other items made available under their own licence terms. PackageIQ grants only the rights specified in these Platform Terms, subject to payment of all amounts due. For the avoidance of doubt, you have no right to use the trademarks, trade names or other designations of PackageIQ.
Your content
You retain ownership of the product information, images and descriptions you submit. By submitting content you grant us a limited, worldwide, non-exclusive licence to process, transmit and store it for the purpose of operating the Platform and generating, delivering and storing your reports. You confirm that you hold the rights necessary to submit that content for this purpose.
Reports and user licence
PackageIQ grants the Client a non-exclusive, non-transferable right to use the Material worldwide solely for the Client's own internal business purposes. Upon payment, that licence extends to the generated report, which you may share with suppliers, colleagues or investors, but which you may not resell or publicly republish without our consent. You shall not modify, make derivative works of, disassemble, web-scrape, reverse compile or reverse engineer any part of the Material, and commercialisation of the Material by the Client is prohibited. Except as expressly granted here, you acquire no licence or right, express or implied.
4) Warranty
Standard of care
PackageIQ warrants that the Material has been developed using reasonable care and skill and in accordance with the description of it contained in these Platform Terms and on the Platform. You will give us timely written notice of any failure to comply with this warranty so that we can correct the corresponding Material. PackageIQ does not warrant uninterrupted or error-free operation of the Platform, that all defects will be corrected, or that the Material will meet your specific requirements.
AI-generated content
Reports, scores, design proposals and citations are generated with the assistance of large language models and image models, and may contain errors, omissions or statements that do not hold for your product or market. Scores are a structured opinion, not a measurement. You assume all risk associated with reliance on report outputs and should verify anything material before acting on it.
Regulatory flags
Reports may flag potential compliance issues under the EU Packaging and Packaging Waste Regulation (PPWR), national labelling rules and related legislation, based on the target market you select. These flags are informational only. Regulatory compliance is your sole responsibility and must be verified with qualified legal and technical advisers. We make no warranty that flagged items represent an exhaustive list of the obligations that apply to your product.
Disclaimer
THE FOREGOING IS PACKAGEIQ'S SOLE OBLIGATION AND THE CLIENT'S SOLE AND EXCLUSIVE REMEDY WITH RESPECT TO ANY BREACH OF THE WARRANTY IN THIS CLAUSE. EXCEPT AS SET OUT IN THIS CLAUSE, PACKAGEIQ EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, TITLE, NON-INFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
5) Tokens, fees and payment
Tokens
Access to paid features is denominated in tokens. 1 token = €1.00 at list price, and token packs are available at volume discounts. Tokens are purchased as a one-time payment rather than a subscription; there is no recurring charge and no automatic renewal. Tokens have no cash value, do not accrue interest and cannot be transferred to another account.
Free scan
The free packaging scan requires no payment. It provides a summary assessment only; detailed findings, design proposals and production files require token expenditure. Free scans are rate limited, and we may change or withdraw the free tier at any time.
Payments and taxes
All payments are processed by one or more third-party payment processors and/or authorised resellers acting as merchant of record ("Payment Processor(s)"). Our current Payment Processor is Paddle.com Market Ltd ("Paddle"); we may add, remove or change Payment Processor(s) at any time. By purchasing tokens you authorise us, or the relevant Payment Processor, to charge your payment method for the stated amount. Prices include applicable VAT where required by law, and you are responsible for any other applicable taxes.
Refunds
Refund requests may be submitted within 3 days of purchase, in line with applicable consumer protection regulations and the policies of our Payment Processor. Requests received after that period will not normally be considered.
You are eligible for a refund if:
- tokens were spent attempting to generate a report but, for any reason, the report was not generated, was not received, is not visible on your profile, or cannot be opened; or
- you have unused tokens remaining from a token pack and no report has been generated using that pack.
If a report was successfully generated but the content is invalid or incorrect, this is not automatically refundable. Please submit the issue via our Contact Form for review; we will respond within 5 working days.
If your refund is approved, we will credit refund tokens to your account by default. A monetary refund to your original payment method will only be issued if you specifically request it and we confirm it is appropriate for your case.
Where our Payment Processor's terms, or applicable local consumer protection law, grant you rights broader than this policy, those rights remain unaffected.

6) Suspension, termination, limitations and modifications
Suspension and cancellation
PackageIQ may cancel or suspend the Platform or the Material, or any right or licence granted under these Platform Terms, in whole or in part, where you breach these Platform Terms, where required by law, or where necessary to protect the Platform or its users. Where a suspension or cancellation is for reasons not attributable to the Client, PackageIQ will decide in good faith, case by case, whether the Client is entitled to a refund of unused tokens in whole or in part.
Termination by you
You may delete your account at any time. On termination, your right to use the Platform ceases immediately. Unused tokens are forfeited on termination for breach; on voluntary account deletion we may, at our discretion, refund unused tokens.
A dispute over unused tokens does not delay a data erasure request made under our Privacy Policy: deletion of your account and personal data is handled independently of any outstanding token balance.
Limitations and modifications
PackageIQ may amend, discontinue or delete parts of the Platform or the Material, including the features included in a given report tier, at its discretion. Such modifications become effective on notification to the Client, which may be given in any form we reasonably consider appropriate, including implementation on the Platform itself. Changes that materially reduce what already-purchased tokens buy will not be applied retroactively to tokens bought before the change.
7) Indemnification and limitation of liability
The Client shall indemnify, hold harmless and defend PackageIQ and its owners, affiliates and related entities, and their respective former, current and future owners, employees, advisers, officers, agents and representatives (the "PackageIQ Indemnified Parties"), from and against all claims, demands, damages, causes of action, costs and expenses (including reasonable legal fees), losses and liabilities of any nature, including liability to third parties, that may be asserted against any PackageIQ Indemnified Party and that arise out of or relate to the Platform, these Platform Terms or the Material and are attributable to the Client, including: (a) any actual or alleged breach of the Client's representations, warranties or obligations under these Platform Terms; (b) the Client's wrongful or improper use of the Material; (c) the Client's violation of PackageIQ's or a third party's proprietary or other rights; (d) the Client's violation of any applicable law or regulation; and (e) any unauthorised third party's access to or use of the Client's credentials.
To the maximum extent permitted by applicable law, PackageIQ's entire liability for all claims in aggregate arising from or related to the Platform or the Material shall not exceed the total amount you paid us in the 3 months preceding the claim.
UNDER NO CIRCUMSTANCES IS PACKAGEIQ LIABLE FOR ANY OF THE FOLLOWING, EVEN IF INFORMED OF THEIR POSSIBILITY: (1) LOSS OF, OR UNAUTHORISED ACCESS TO OR DAMAGE TO, DATA; (2) SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE OR INDIRECT DAMAGES, OR ECONOMIC CONSEQUENTIAL DAMAGES; OR (3) REPUTATIONAL DAMAGE, LOST PROFITS, LOST BUSINESS, LOST REVENUE, LOST GOODWILL, DELAYS OR ANTICIPATED SAVINGS.
Nothing in these Platform Terms limits liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under applicable law, including mandatory consumer protection law.
8) Data protection and confidential information
Data protection
The Client is responsible for the data it makes available to PackageIQ in connection with the Platform, including its accuracy, quality and completeness, and for having a lawful basis to submit it. Each Party shall comply in all respects with applicable data protection law, and shall implement administrative, physical and technical safeguards appropriate to the personal data under its control that are no less rigorous than accepted industry practice. Each Party will notify the other without undue delay of any security breach affecting the other's data and use commercially reasonable efforts to mitigate it. The Parties will provide each other with reasonable assistance in carrying out data protection impact assessments, in consultations with a regulator, and in responding to data subject requests. Our own processing of personal data is described in our Privacy Policy.
Confidential information
Neither Party will use or disclose the other Party's confidential information, trade secrets or proprietary information ("Confidential Information") more than is necessary to access the Material or to enable PackageIQ to provide the Platform. Each Party will use the same care and discretion to avoid disclosure of the other's Confidential Information as it uses for its own, and no less than reasonable care. A receiving Party may use and disclose information that: (a) it already held without obligation of confidentiality; (b) it developed independently; (c) it obtained from a source other than the disclosing Party without obligation of confidentiality; (d) is or becomes publicly available through no fault of the recipient; (e) the disclosing Party disclosed to another without obligation of confidentiality; or (f) is required to be disclosed by law or court order, provided the receiving Party gives prompt written notice where permitted and cooperates in limiting the disclosure.
9) General principles of our relationship
Notices and communications
Written communications to PackageIQ must be sent to the address or email address given in the Contact section below. Communications to the Client are sent to the email address held on the Client's account. The Parties consent to the use of electronic means to send and receive communications in connection with these Platform Terms, and agree that such communications count as being in writing. It is your responsibility to keep your account email address current.
Compliance with laws
PackageIQ will comply with the laws applicable to us in providing the Material. PackageIQ is not obliged to undertake any action under these Platform Terms which, in our reasonable determination, would not comply with applicable law or regulation. The Client will comply with the laws applicable to the Client's business as they relate to the Client's obligations under these Platform Terms.
Dispute resolution and governing law
The Parties will attempt in good faith to resolve informally any dispute, disagreement or claim between them before commencing proceedings. These Platform Terms are governed by the laws of Bosnia and Herzegovina, without regard to conflict of law principles, and any dispute is subject to the exclusive jurisdiction of the courts of Sarajevo, Bosnia and Herzegovina, unless mandatory consumer protection law in your country of residence requires otherwise.
Force majeure
Neither Party is liable to the other for any failure or delay in performing its obligations due to causes beyond its reasonable control, such as fire, flood, earthquake, acts of war, terrorism, riot, pandemic or epidemic, communication line or power failure, the failure or withdrawal of a third-party AI or infrastructure provider, or governmental laws, court orders and regulations imposed after your purchase (each a "Force Majeure Event"). Delays caused by a Force Majeure Event extend the affected completion dates by the duration of the event plus a period that is reasonable in the circumstances.
Construction, severability and survival
Headings and clause references are for convenience only and do not define or limit the scope of any provision. The invalidity or unenforceability of one or more provisions does not affect the validity or enforceability of the others; where an invalid provision would be valid if appropriately modified, it applies with the modification necessary to make it valid and enforceable consistent with its objective. Any provisions that by their nature extend beyond termination remain in effect in accordance with their terms and apply to both Parties' successors and assignees.
10) Other
Trade name use
Neither Party may use the other's trademarks, trade names or other designations in any promotion, publication or website without the other Party's prior written consent.
No partnership and no third-party rights
These Platform Terms and any use of the Material do not create an agency, joint venture, employment or partnership relationship between the Client and PackageIQ, and PackageIQ is free to enter into similar agreements with other clients. No right or cause of action is created for any third party by these Platform Terms, and PackageIQ is not responsible for third-party claims against the Client except as expressly set out here.
No other rights and claims lapse
Each Party grants only the licences and rights specified in these Platform Terms; no other licence or right is granted, directly, by implication or otherwise. Except where prohibited by applicable law, any claim for breach of these Platform Terms must be brought within twelve (12) months from the date on which the Party first became, or reasonably ought to have become, aware of the alleged breach, after which the claim lapses.
Use of contact information
The Client authorises PackageIQ and its successors, assignees, contractors and representatives to store and use the Client's business contact information in connection with PackageIQ products and services and in furtherance of our business relationship with the Client, in accordance with our Privacy Policy.
Entire agreement, acceptance and consumer rights
These Platform Terms constitute the complete agreement between the Client and PackageIQ regarding the Platform and the Material, and replace any prior oral or written communication between the Parties on that subject. Neither Party relies on any representation not specified here, such as estimated costs or results of any Material, and additional or different terms in any written communication from the Client, such as a purchase order, are void. Each Party accepts these Platform Terms by electronic acceptance in the Platform.
